This Artificial Intelligence Policy (“AI Policy”) applies to Customers and other users (collectively, “Users”) of the Maxyfi platform and the Maxyfi website (collectively, the Maxyfi “Platform”) that incorporate artificial intelligence capabilities.
This AI Policy is intended to provide Users with information regarding Maxyfi’s AI-related handling of personal and financial information, along with guidelines governing the use of AI within the Platform. This Policy should be read in conjunction with Maxyfi’s Terms of Service and Privacy Policy.
1. What This Policy Covers
This Policy explains how Maxyfi (“we,” “us,” or “our”) protects data when Users interact with Maxyfi’s AI-powered software, agents, and automated decision-making tools (collectively, “AI Functionality”).
AI Functionality includes, but is not limited to:
- Customer-Assistant Chat-Bot: An interactive agent capable of negotiating with payees, processing “pay now” requests, arranging payment plans, handling callbacks, and logging disputes.
- Vision-AI: A document-processing tool that extracts data from invoice images (including PDFs) and converts it into structured CSV formats with user-defined columns.
- Template Generation: A generative tool that creates SMS, email, or letter templates based on user-provided prompts.
- Filter-AI: A natural language processing tool that enables Users to filter CRM data using simple text prompts.
2. User Data and AI Training
- No Training on Personal Data: Customer-specific data, including debtor names, debt amounts, and financial histories, is never used to train Maxyfi’s public or foundational AI models. Proprietary business data belonging to one Customer is not used to improve AI models for other Maxyfi Customers.
- Data Isolation: When Users utilize features such as Vision-AI to process invoices, extracted data is processed solely to deliver the requested output (for example, a CSV file). This data is not retained or reused to improve system performance for other Users.
- Third-Party Models: Certain AI Functionality relies on trusted third-party providers, such as large language models used for Template Generation. Maxyfi contractually requires these providers to refrain from using User data to train or enhance their general-purpose models.
3. Security and Accuracy
- Human Oversight: While tools such as the Customer-Assistant Chat-Bot and Filter-AI operate in an automated manner, Maxyfi recommends that Users maintain appropriate human oversight, particularly for sensitive actions such as dispute resolution or approval of complex payment arrangements.
- Accuracy Considerations: Generative AI used in Template Generation may occasionally produce inaccurate or incomplete outputs. Users are responsible for reviewing all AI-generated communications, including emails, letters, and SMS messages, to ensure accuracy and compliance with applicable laws and regulations, such as the Fair Debt Collection Practices Act (FDCPA), prior to distribution.
4. Data Roles and Ownership
- Maxyfi as Data Processor: When Users employ the Platform to collect debts, manage invoices, or analyze customer data, those Users act as the Data Controller of the relevant information. Maxyfi acts as the Data Processor and processes such data solely to provide the requested AI-enabled services.
- User Responsibilities: Users are responsible for ensuring that their use of AI features, including automated negotiation and communication tools, complies with all applicable laws, regulations, and industry standards within their respective jurisdictions.
5. Third-Party AI Subprocessors
To deliver advanced functionality such as natural language understanding for the Customer-Assistant Chat-Bot and Filter-AI, Maxyfi may engage trusted third-party AI service providers. These subprocessors process data exclusively to generate the responses or actions requested by Users and are prohibited from using such data for their own independent or unrelated purposes.
Changes To The AI-Policy
We reserve the due right to modify this Artificial Intelligence Policy at anytime. If we make material changes to this Artificial Intelligence Policy, we will notify you by updating the date of this Artificial Intelligence Policy and posting it on the website.
